Types of Restraining Orders
In Minnesota, there are three types of restraining orders. Minnesota courts can issue a restraining order either upon the victim’s request or when someone is facing criminal charges of domestic abuse or violence.
The court may issue a(n):
- Order for Protection: An OFP is issued against someone who has allegedly committed domestic violence. It is requested by the victim.
- Harassment Restraining Order: An HRO is issued against someone who is scaring, threatening, or intimidating a person and is not related to them.
- Domestic No-Contact Order: DANCO orders are generally issued by courts in situations of alleged domestic abuse where the victim has not requested protection. They cannot be dismissed and they remain in place for the length of time that criminal charges are pending.
Defending Allegations & Fighting Restraining Orders
In the event that you have been wrongfully accused of violence or abuse, do not panic – you have options. If someone has taken out a restraining order against you without justification, you have the right to fight it.
Keep in mind, however, that you should obey and respect the restraining order as you pursue legal action. Violating the order will only make things worse.
Our Moorhead restraining order attorney can build a strong defense on your behalf as we fight the order and seek to get it overturned.
